Terms of Service

These terms govern your access to and use of MediaMint — the infinite canvas for AI-generated video, image, and audio. By creating an account or using the service, you agree to them.

1. Acceptance of these terms

MediaMint (“MediaMint”, “we”, “us”) provides a web platform for generating and organizing media with AI models. By using the service you enter into a binding agreement with us consisting of these Terms of Service, our Privacy Policy, our Cookie Policy, and our Acceptable Use Policy. If you use MediaMint on behalf of an organization, you represent that you have authority to bind that organization, and “you” refers to it.

2. The service

MediaMint gives you access to third-party AI models for image, video, and audio generation on a shared infinite canvas, along with workspaces for real-time collaboration, an asset library, and related tools. Generated media and uploads are stored on cloud object storage (Backblaze B2). We may add, change, or remove features at any time; if a change materially reduces what a paid plan includes, we will give you reasonable notice.

3. Accounts and eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) to use MediaMint, and at least 18 to purchase a paid plan. You are responsible for your account credentials and for all activity under your account. Keep your registration information accurate, and tell us promptly at support@mediamint.app if you suspect unauthorized use.

4. Credits, plans, and billing

Generation on MediaMint is metered in credits. How you get them:

  • Free tier. Every account receives a daily credit allowance that refills each day and does not roll over.
  • Subscriptions. Paid plans (Starter, Pro, Ultimate) grant a monthly credit allowance to your personal workspace. Subscriptions renew automatically each billing period until cancelled.
  • Top-ups. You can purchase additional one-time credit packs.
  • Workspace pools. Each workspace has its own credit pool, funded by its own allowance and top-ups; credits are drawn from the workspace a generation runs in.

Different models and settings consume different amounts of credits; the cost of a job is shown before or as you run it. Payments are processed by Stripe — we do not store your card details. Prices may change; changes to subscription pricing take effect at your next renewal after notice. Except where required by law, credits have no cash value and are non-refundable, including credits consumed by generations you are unsatisfied with.

5. Cancellation

You can cancel a subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period; you keep access to paid features and remaining monthly credits until then. Unused monthly credits expire at the end of the period in which your subscription ends. Purchased top-up credits remain usable while your account is in good standing.

6. Your content

“Your content” means anything you upload to MediaMint (images, video, audio, files) and the prompts you write. You retain all rights to it. You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, and display your content solely to operate and improve the service — for example, to render it on your canvas, share it with workspace members you collaborate with, deliver it through share links you create, and pass prompts and inputs to the AI models you invoke. You are responsible for having the rights to everything you upload.

7. Generated content

Subject to these terms and your compliance with them, we assign to you all of our right, title, and interest in the media you generate on MediaMint, to the extent permitted by law. Be aware of the nature of generative AI:

  • Output may not be unique — other users with similar prompts may receive similar output.
  • Output may be inaccurate, and may unintentionally resemble existing works, people, or trademarks. You are responsible for reviewing output and for how you use it.
  • The upstream model providers whose models you invoke may impose their own usage terms; where they do, your use of that model’s output must also comply with them.
  • Copyright protection for AI-generated works varies by jurisdiction; we make no representation that generated output is protectable.

8. Acceptable use

Your use of MediaMint must comply with our Acceptable Use Policy, which is part of these terms. In short: no illegal content, no abusive or deceptive synthetic media, no violating other people’s rights, and no abusing the platform itself. We may remove content or suspend accounts that violate it.

9. Workspaces, collaboration, and sharing

When you join a workspace, the content you place on its boards is visible to and editable by its members. Workspace owners and admins control membership. If you create a public share link for a board, anyone with the link can view that board’s content — treat share links as public. You can revoke a share link at any time, though media already downloaded by others is beyond our control.

10. Third-party services

MediaMint is built on third-party infrastructure and models — including model hosting and inference providers, Backblaze B2 for media storage, Supabase for authentication and data, Stripe for payments, and Google for assistant features. We are not responsible for the availability of these services, and temporary model unavailability is not a defect of MediaMint.

11. Our intellectual property

The MediaMint software, design, and brand are ours or our licensors’. These terms don’t grant you any right to them beyond using the service as intended. You may not copy, modify, reverse engineer, resell, or create derivative works of the service except as permitted by law.

12. Copyright complaints

We respond to notices of alleged copyright infringement. If you believe content on MediaMint infringes your copyright, send a notice to legal@mediamint.app including: the work infringed, the URL or share link of the infringing material, your contact details, a good-faith statement that the use is unauthorized, a statement under penalty of perjury that your notice is accurate, and your physical or electronic signature. We may terminate the accounts of repeat infringers.

13. Suspension and termination

You may stop using MediaMint and delete your account at any time. We may suspend or terminate your access if you materially breach these terms, if required by law, or if your use creates risk or harm to the service or others — with notice where practicable. Upon termination, your right to use the service ends; sections that by their nature should survive (including 6–7 and 14–16) survive.

14. Disclaimers

THE SERVICE AND ALL GENERATED OUTPUT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION. YOU USE GENERATED OUTPUT AT YOUR OWN RISK.

15. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEDIAMINT WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE AND (B) USD $100. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITS, SO THEY MAY NOT FULLY APPLY TO YOU.

16. Indemnification

You will indemnify and hold MediaMint harmless from claims arising out of your content, your use of generated output, or your breach of these terms, except to the extent caused by our own breach.

17. Changes to these terms

We may update these terms as the service evolves. For material changes we will notify you (for example by email or an in-app notice) at least 14 days before they take effect. Continuing to use MediaMint after a change takes effect means you accept it; if you don’t, stop using the service and cancel any subscription.

18. Governing law and contact

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws rules, and disputes will be resolved in the courts located there, unless the law of your country of residence requires otherwise. Questions? Contact legal@mediamint.app.
